Part A — Voluntary Return Policy
1. Our Voluntary Return Policy
Badertscher Tool AG voluntarily grants private customers (consumers) the right to return ordered in-stock items without giving a reason within 8 days of receiving the goods.
The return can be requested in the following ways:
- In writing via email to mail@b-tool.ch
- In writing by mail to our address below
- By returning the goods within the deadline — the return is at the customer’s risk and expense

Please ensure the package is properly stamped. Shipments sent collect will not be accepted.
3. Condition of the returned goods
You may inspect the goods before returning them—just as you would have been able to do in a retail store. Any use beyond this is considered use and entitles Badertscher Tool AG to deduct a reasonable reduction in value.
For a full refund, the goods must meet the following requirements:
- Unused, unworn, unwashed, and without signs of use
- In the original packaging with intact original labels
- Complete (including accessories, inserts, and documentation)
- A regular stock item (not a special item, not a special order)
In the case of damaged, worn, or incomplete merchandise, Badertscher Tool AG reserves the right to deduct the loss in value from the refund amount.
4. Excluded from return
The following items are expressly excluded from the voluntary right of return:
- Custom-made items and items manufactured to customer specifications (custom sizes, custom colors, Flexi-Color items, etc.)
- Printed, embroidered, or otherwise personalized items
- Underwear, thermal underwear, T-shirts, shirts, socks, and similar hygiene items
- Items from special sales and discontinued items
- Goods that have already been worn, used, or washed
- Audio or video recordings and software, provided the data carriers have been unsealed
- Newspapers, magazines, and periodicals
- Perishable goods or items whose expiration date has passed
5. Refunds
Upon receipt and inspection of the returned goods, Badertscher Tool AG will refund the purchase price within a reasonable period of time via the same payment method the customer used when placing the order, unless otherwise agreed.
Any shipping costs for the original delivery as well as the costs of the return shipment will not be refunded. We reserve the right to deduct a reduction in value if the goods are not in proper condition.
6. Relationship to the Terms and Conditions and the Statutory Warranty
This voluntary right of return supplements the General Terms and Conditions (GTC) of Badertscher Tool AG. The statutory warranty rights under the Swiss Code of Obligations (Art. 197 et seq. CO) remain unaffected and are described in Part B of this page.
In the event of any conflict between these return conditions and the Terms and Conditions, the Terms and Conditions shall apply, unless the return policy contains a provision that is more favorable to the customer.
Part B — Statutory Warranty & Guarantee under the Swiss Code of Obligations
7. Legal Basis
The statutory warranty is governed by the Swiss Code of Obligations (CO), in particular by Art. 197–210 CO (warranty for material defects upon purchase). It applies independently of the voluntary right of return and cannot be restricted or waived by the latter.
Badertscher Tool AG distinguishes between private customers (consumers) and commercial customers (businesses), as the CO provides different regulations for these groups.

9. Warranty for Private Customers
As a private customer (consumer), you benefit from the following statutory warranty rights, which are mandatory and cannot be restricted by the General Terms and Conditions:
- Warranty period: 2 years from delivery (Art. 210 para. 1 OR). The period cannot be shortened by contract.
- Reversal of the burden of proof: If a defect becomes apparent within 6 months of delivery, it is presumed by law that the defect was already present at the time of delivery. Badertscher Tool AG must prove otherwise.
- Obligation to give notice of defects: Any defects discovered must be reported to Badertscher Tool AG in writing within a reasonable period of time after discovery. Art. 201 of the Swiss Code of Obligations (OR) applies; consumers are not required to give immediate notice.
- Rights in case of defects: You may, at your discretion, demand repair or replacement . If the subsequent performance fails, you are entitled to a reduction in the purchase price or rescission (return for a refund).
10. Warranty for commercial customers (B2B)
The following terms apply to purchases made by businesses (commercial customers registered in the Commercial Register):
- Warranty period: 1 year from delivery. The statutory period of 2 years is contractually reduced to 1 year in accordance with Art. 210 of the Swiss Code of Obligations (OR).
- Obligation to Report Defects Immediately (Art. 201 Swiss Code of Obligations): Commercial customers are obligated to inspect the goods immediately upon receipt and to report any defects in writing without delay. Hidden defects must be reported immediately upon discovery. A delayed complaint results in the loss of warranty rights.
- Rights in Case of Defects: Badertscher Tool AG shall, at its sole discretion, choose between repair and replacement. If the subsequent performance fails twice, the buyer is entitled to a price reduction or rescission.
- Burden of proof: The commercial customer bears the burden of proof that a defect was already present at the time of delivery.
11. Manufacturer’s Warranty
Many of our products come with a voluntary manufacturer’s warranty (e.g., Milwaukee, Hultafors, Snickers Workwear). This warranty is distinct from the statutory warranty:
- The manufacturer’s warranty is provided directly by the manufacturer and is subject to its warranty terms and conditions.
- It supplements the statutory warranty and does not limit it.
- Warranty claims must be filed directly with the manufacturer or through Badertscher Tool AG. We will assist you in processing the claim to the best of our ability, but we do not assume any liability for the fulfillment of the manufacturer’s warranty.
- Please refer to the warranty documents included with the product or the manufacturer’s website for the scope and duration of the manufacturer’s warranty.
